This qualitative research project would explore how lesbian, gay, bisexual, transgender and intersexual people determine that hate-motivated crimes are based on their sexuality or gender identity. The study of hate crime victimisation is meant to engage victims of homophobic and transphobic hate crimes and record their views on the nature, forms and impact of hate based violence. The proposed research will also assist in exploring experiences of this unique population who are often ignored, because such concepts as sex, gender, homophobia, transphobia are not included in the criminological research. Research is going to be conducted on how people determine that violence is based on either their actual sexual orientation or gender identity or as perceived by the offender. The main aims are to compare the empirical findings based on in-depth interviews about people’s experiences of hate crimes because they are perceived to be lesbian, gay, bisexual, transgender, or intersexual; to see whether hate crimes have been reported and follow up the cases and to see how hate crimes influenced victims and their families. Through the in-depth interviews with victims and experts I am hopeful to document typical experiences of LGBTI persons; find out, whether including homophobia and transphobia in hate crimes legislation is justifiable. This question is especially interesting in the light of intersectionality. I would also like to find out which group is more targeted by the anti-LGBTI violence and and how the overall societal situation impact individual experiences as well as why the homophobic and transphobic incidents remain underreported. My research aims to contribute to the prevention of homophobic and transphobic incidents and provide grounds for the necessity for legislative changes as well as contribute to the better protection of LGBTI people through better strategies for law enforcement training. It is my hope that my research will also translate in longer term into increased recognition of the rights of LGBTI people – including the right to be protected from violence – as human rights.
